In Febuary I brougt to clean 1 'juicy' zip up jacket. When I picked it up next week I have given them 1 more 'juicy'jacket. Next morning I whent to put it on /1st one/ the zipper was missing. /I heared one from someone that some cleaners still the zipper -mooving piece do to value /I never thought it could happened to me. I called the to let them know about the problem and told them to look further to the second one that was to be ready to be picked up-after examining my other jacket manager said it was also missing zipper. I called,negotiated to get this resolved,I was told that the reason it taking ,so long because 'They whanted to make it right!' Ther regeonal manager said that he is trying to get in touch with the 'juicy' company to proffetionaly re-place bolth zippers. It has been 2 month!They held my clother and finally returned it to me on last tursday -damaged! The zipper that was instaled was not only not'Juicy' with letter 'J' it was compleately wrong.I was told to get out and if I have any questions to call their customer servise/massaging system/ No one called me back. I'm not only upset they have not re-placed zipper or my both jackets. I whan to file a suit agained them to teach them a lession! I spent 3 month in the hospitals with my 7 y.o. son that undrwent bone marrow transplant,I told manager that this sport suits was purchaced to wear in the hospital! They didn't care. Please help me. Breach of contract. I am a volunteer with SB since 2006. I am an immigrant not allowed to work because of my visa. When I lost my job because of change of status, I found this organization a worthy cause. I told them I had two little children in preschool age. I believe preschool education is a right for each child and I was looking for a way to have my children in some program, which I otherwise can't afford because we are low income. They promised me a scholarship to have them in preschool so I could dedicate myself full time to the program. There were conflicts and they started procrastinating the scholarship payments. I ended up paying the day care myself, but I stayed in the program because of the cause. I was supposed to sell fair trade clothing, and they told me that with sales picking up they would be able to pay the overdue scholarship money. After 9 months, I took the children out of day care but I kept working in the program from home and once a week in the office. At that point, they owed me over $5,000. I agreed to have this money refunded to me whenever we would have a sale (and thus money in the program). The problem is that they did everything possible to keep me from being successful in the program. I received no support for my sales efforts. They promised to put some money in branding, a newsletter, and other things that would help me sell. But they did not invest a single dime. I put up a web site and got some services for free as donations. I also wanted to go to fairs to promote the program, but they said they did not agree with this strategy. We made some sales but it was slow. Every time I had to beg to receive my share of the money as a refund for the child care expenses. At this point they still owe me $2,300. I feel pressured to stay in the program and keep working for free (since I'm still not allowed to have a job). However, they still don't support anything I do and make it impossible for me to 'just sell'. I really want this money back that is owed to me since early 2007 and I want to leave the program. I have documentation that shows how they interpret this issue in a different way than what was intended. In short, I never intended to pay money so I could work for them for free. They know that we live paycheck to paycheck. I also never asked them for a 'sales commission', which they now say it is, since I'm not allowed to work. I only want the scholarship that they had promised me and that I ended up paying for myself.

I don't necessarily want to sue them and I'd prefer to solve this peacefully. But I do feel I need at least an outside moderator who can objectively look at this and talk with them. This is a nonprofit so called working for social justice and fair labor practices with their workers. So ironic!

I was hired as the director of sales in Feb 2008. The company had a history of personnel issue that were in existance long before I joined. I was told of these issues. The issues were not performance related or job related, simply just pesonality conflict. In the last month I brought it to the attention of the President and VP's that the unrest was mounting and that it was due to a Director that was selectively picking on certain employees. She was disapproving sales by sales reps based on bogus info. such as the area was to close to a Baby's R US or that the area was saturated. The VP and Director got upset and it put a process in motion that led to the following. They want me to carry out a verbal and final written warning and they asked me to fire a regional manager. These people were all producing at >100% and none of them have ever been verbally warned or written up. I stated that I thought what they wanted was wrong and due to personality issues only and I refused to fire the RM. From that date, I was told that they could not trust me in their management team and within 30 days I was fired without cause.

I was dating someone who was going through financial troubles. I loaned him a total of $750 to help him out, and he agreed to pay me back when he had the money. The money was loaned in February. The relationship ended mutually in the beginning of April and he said he was getting a loan to pay me back, and to pay off the other debts he still had. He said i would have my money by the end of the month (April). We remained in contact, as i would call him every week or so to get status on the loan. He gave various reasons for the delay once the end of April passed, that there was extra paper work that he needed to fill out and then he was waiting on the review and approval. Our last conversation took place in mid-May, which i received the same response, that it was coming. His phone was off towards the end of May, (this happened roughly every other month or so when he had not payed off his cell phone bill, as he is paid on the 1st and 15th every month) so i emailed him instead, asking when i could expect to see the money and asking that he call me within about 3 days, otherwise i would be filing a small claims case against him at the county court house. He called either the same day or the following day at 2:00 am and left a message that was hardly audible (i believe he was drunk) stating that he would have the money in 2 or 3 weeks. I tried calling the number back the next day that he had called me from, however no one answered, neither that time nor the following 3 times i tried it. At this point (early June) his phone was still not receiving calls and now said that the number had been changed, disconnected or no longer in service. He is pretty dependent on his phone for work, so i assumed that he changed his number. I also tried many times to contact him on his work number, which i had often been able to reach him on when we were dating, however i was never able to get a hold of him. As well, his work number does not have a voicemail, as it is directed to a fax machine. I again emailed him, stating that i could not clearly understand his 2:00 am voice message, and asked that he call me within about 2 days on my cell phone and either speak to me directly, providing a date when i could expect to receive the $750 he owed me, or if he did not get a hold of me, to leave a number at which i could get a hold of him. I also gave him the option to pay me in payments if he was not able to pay all of the money at one time. I again told him that if i did not hear from him by the specific date mentioned, that i would be filing a small claims case against him. He never responded.

I would still like to pursue a small claims case against him, however, I would first like to know what I can expect going into this, given that the case is entirely based on a verbal contract. From the information I have read online, verbal contracts are binding in the state of Illinois, however, when researching the process for filing small claims on both the Lake County, IL website (i live in Lake County) and the Kane County, IL website (he lives in Kane County) it states that it is not the defendants job to prove their innocence, but the plaintiffs job to prove the defendant is guilty. Do you think it is likely that I will get anywhere with this? I plan to have a sherriff hand deliver the summons, and don't doubt that he will show up in court. As well, I believe that he will be honest with a judge and agree that he does owe me the money, so if I can get this into court I believe I have a likely chance of winning, however I have concerns that I may not have enough "proof" to get the case to that point. Please provide any information you have relating to what I can expect when filing this case, the likelyhood of it being taken in front of a judge and if there are any steps I should look out for or possibly try for that would improve my chances of winning. Sought another opinion. New doctor said he didn't know why Jamerson said sound wuld go away..it won't. Devestated! Sought third opinion from specialist at Northwestern. Told same thing. Sound will not go away and unusual to see an adult with tubes.

I would NEVER of agreed to have my ear drums cut open if there was no hope of ringing to stop. Dr. Jamerson continually told me "it" would go away. I even had him qualify that statement by asking him if the ringing would go away or would I just get used to it. He said "No. It will go away."

I ordered granite countertops with a certain edge. The next day less than 24 hours later I called and changed the edge, both were included in the cost. When the countertops came in they were wrong and I asked for a discount, it was denied. I had to pay an additonal $500 to another fabricator to cut a small part of the countertops so that the stove could fit, it would have fit had they done the other edge. I paid them half and when I was refused a discount, I deducted the $500 from the balance as well as 15% from the total, wrote the check put pd in full on the memo. He cashed the check, but now I am being sued for the full amounf of the balance. Is this legal?

Approximately two weeks later they started to take longer in returning my calls to tell me which job site to go to. They said there was no work. Downer Lofts Analysis 8.8.08 www.downerplacelofts.com 1. Sale of building into Partnership Page 2 (7) (i) (presently owned by affiliates of White Elephant and A.S., Inc. … $325,000) Valor’s purchased the property for $175,000 and once Valor brought Scott into the deal the agreement was to sell the property into the new partnership with Berger for $325,000 with Valor and Scott splitting the difference between the $175,000 purchase price and the $325,000 sale. According to Scott the city insisted that the difference be kept in the project as equity until they were paid off their $1.1 million zero interest loan from the sale of the lofts. Scott told Valor after the 4.20.94 closing that he and Valor would be getting the 3% over prime based on LaSalle National Bank per UWD agreement.* Scott informed Valor around 96-97 that now that Downer turned rental, the fees were going to be stuck in the project until the rentals were converted back into condos. The project owes Valor for the sale plus interest from the date of the closing. $75,000 plus interest* from 4.20.1994 until Valor’s paid (@ 8% = $154,975.4 from 1995 though 2009) 2. Signing personal/ profit fee This is a side agreement with the city for an extra $240,000 to go to the partnership being that the projects projections weren’t enough to make the deal worth pursuing unless they did. The amount was for $240,000 to be split three ways. Once again Scott lied and when Downer turned rental the fees were then stuck (again according to Scott) in the project until the rentals were converted back into condos. $80,000 plus interest* from 4.20.1994 until Valor’s paid 3. Partnership Management fee Page 4 VIII paragraph two: Except for the … will require approval of a Voting Majority. The partners voted at the August 93 meeting that Berger’s partnership management fee would be indefinitely terminated due to the fact that Berger was getting paid as the project manager, architect, and construction manager. In addition it was decided that the partnership was going to dissolve, thereby no need for any management services. Page 5 Partnership Administration. Paragraph two: Notwithstanding the foregoing, in event that ( i ) the Partnership or an operating Partnership has not acquired one of the Identified Properties by January 1, 1993, or ( ii ) the Partnership has not commenced construction on the Downer Building or Aurora Hotel by May 1, 1993, then the Administration fee shall cease. UWD will be under no further responsibility to provide any continued service to the Partnership until such time as either condition ( i ) or ( ii ) is met. The Lofts went under construction April 20, 1994. In 94 Berger talked Scott into reinstating the fee once Valor had withdrawn thereby paying Berger $3,000 a month backdated to January 1, 1993 until September 1, 2000 at which time they reduced the amount to $1,500 a month and ongoing. Scott owes Valor the amount he let Berger ( and maybe Scott) take out of the Loft development from January 1, 1993 until present, plus interest*. May 1, 1993 through August 31, 2000 @ $3,000 a month = $264,000 Sept. 1, 2000 through August 31,2008 @ $1,500 a month = $126,000 Unauthorized partnership management fees charged so far $390,000 $390,000 plus interest from 4.20.1994 until Valor’s paid 4. Developers fees Page 6 (e) Developer Fees. To the extent that… such fee shall be split equally by UWD and White Elephant (or their respective designees). The Lofts paid out $300,000. Scott took Valor’s share and lied by saying that the city made the project keep in the equity of the sale of the lofts into the Partnership, signing/profit fee, and the developer fees until the city were paid back their $1.1 million zero interest loan from the sale of the lofts. $150,000 plus interest* from 4.20.1994 until Valor’s paid 5. Brokerage fees Page 7 (f) Brokerage. Paragraph two: White Elephant or its affiliate shall designate the listing Broker for the sale of the condominium units. The paragraph uses 5%, but being that this is now a conversion it was adjusted up to 6%. With the sell out not to be under $7 million Valor lost a minimum of half, or 3% of the $7 million ($210,000) by not having his chosen Broker given the listing. $210,000 owed ( plus an additional $210,000 less the few sales that a commission was paid out to cooperating brokers. Now that the building is not being listed at all, Valor should be compensated for the rest of the building or given the listing) Berger and Scott are not waived from paying commissions on units they purchased; therefore Scott owes Valor the commissions he allowed to be withheld from units they both invested in. $420,000 less any cooperating broker’s fees paid out to date. Plus Berger and Scotts commissions owed on units they purchased net of commissions. 6. Expense Reimbursement Page 7 (g) Expense Reimbursement Being there is a dispute amongst the partners that falls under the Arbitration clause, Valor’s expense of filing the dispute under the AAA should be reimbursed. Page 19 (g) ARBITRATION The arbitrator’s fees and other cost of the arbitration proceedings shall be borne by the Partnership. $25,000 Due Valor for out of pocket expenses (exact amount per Rotunno’s final invoice) 7. 2006 – August 2008 Rental The mortgage of $550,000 @ 7% = $38,500 a year $38,500/ 23 units = $1,674 per unit. $1,674/ 12 months = $140.00 per month per unit Currently 23 units @ an average of $13,200 ($1,100 a month) a year are being rented. Scott claims he did get any of the cash from the loan and that he believes all of it went back into the building. B. Part of the final deal with the city was to allow the project to borrow an additional $550,000 to refresh the property and get it ready for sale. Most of these funds, according to records from a FOIA went to Berger’s companies. These funds need to be looked at. Until these funds can be accounted for we are taking the stance that they were pocketed by Berger/ Scott. $300,000 1/3rd due Valor out of questionable loans until there accounted for * Page 3 (c) Additional Funds: States that any additional funds will receive 3% over prime based on “LaSalle National Bank of Chicago”. 8.8.08 Notes: From: AMENDED AND REINSTATED LIMITED PARTNERSHIP AGREEMENT FOR Downer Place Lofts L.P. 1. I was involved in a truck/train accident back in 2003 near Dubuque Iowa/Illinois. I was the driver of the semi and there were no injuries or fatalities in the crash. I carried insurance as did the company I was driving for. I had the proper coverage and a paper that was signed by my boss/owner of the trucking company agreeing that I had the proper coverage and I was able to begin driving for their company. Now, 4-5 years later, the company's insurance company has sent paperwork in to have my Iowa driver's license suspended until I pay them the $18,000-$22,000 for their loss of their trailer....which my insurance company has already paid for. I have hired 2 different attorney's....one being in Chicago...who altogether quit corresponding with me. I have talked to several Iowa attorneys who tell me this doesn't sound legitimate, but since the accident was in Illinois, I need to have an attorney who is licensed in Illinois. I need answers on what my rights are and what I need to do at this point. I will need to take a 2nd mortgage out on my home to pay this bill........Please help me...I am desperate, and nobody has any answers for me or can lead me in the right direction.
